1. ELIGIBILITY AND ACCOUNT REGISTRATION

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

To access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for safeguarding your account credentials.

2. INTELLECTUAL PROPERTY RIGHTS

Ownership: The Service, including all text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and AI-generated content (unless otherwise specified), is the property of Aimdal or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

Proprietary Content: All content surfaced through the App, including but not limited to AI-generated travel insights, historical narratives, location descriptions, and curated recommendations, is proprietary to Aimdal.

Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. This license does not include any right to resale or commercial use of any part of the Service.

3. RESTRICTIVE USE AND PROHIBITED ACTIVITIES

You are strictly prohibited from engaging in any activity that compromises the integrity or exclusivity of our Service. Prohibited activities include, but are not limited to:

• No Scraping: You may not use any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Service or to extract data.
• No Data Mining: You may not engage in any data mining, data harvesting, data extracting, or any other similar activity in relation to the Service.
• No Unauthorized Sharing: You may not share, distribute, publish, or otherwise make available any proprietary content or AI-generated narratives from the App to third parties for commercial purposes or in any way that competes with Aimdal.
• No Reverse Engineering: You may not attempt to reverse engineer, decompile, or disassemble any aspect of the Service, or do anything that might discover source code or bypass measures employed to prevent or limit access to any part of the Service.
• No Abuse: You may not use the Service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Service.

Violation of these restrictions may result in immediate termination of your account and legal action where appropriate.

4. SUBSCRIPTIONS AND PAYMENTS

Certain features of the Service require a paid subscription ("Pro Version"). Payments are handled exclusively through the Apple App Store or Google Play Store. Your subscription is subject to the terms and conditions of the respective store.

Subscriptions may automatically renew unless cancelled. You can manage and cancel your subscriptions in your device's account settings. We use RevenueCat to manage subscription entitlements.

5. AI GENERATED CONTENT DISCLAIMER

The Service uses artificial intelligence to provide travel recommendations and information. While we strive for accuracy, AI-generated content may contain errors, be outdated, or provide incomplete information. Aimdal does not guarantee the accuracy, reliability, or completeness of any AI-generated content.

You should verify all travel information (e.g., opening hours, safety advisories, location details) independently. Aimdal is not responsible for any decisions made based on AI-generated suggestions.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIMDAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. DISCLAIMER OF WARRANTIES

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AIMDAL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. GOVERNING LAW

These Terms and any dispute related to them shall be governed by and construed in accordance with the laws of Girona, Spain, without regard to its conflict of law provisions.

9. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date or through in-app notifications. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
